I give the Westgate Las Vegas Resort & Casino and its officers, employees, agents and representatives authorization to obtain and verify my financial information from any source and to exchange such information with others about my financial and account experience with the Westgate Las Vegas Resort & Casino. I agree not to hold any person or entity responsible or liable for the information released, and further agree not to hold the Westgate Las Vegas Resort & Casino responsible or liable for its use of any such information. I agree that the Westgate Las Vegas Resort & Casino may retain and use the information I provide on or in conjunction with any credit application or front money deposit and any information it received based on my authorization, including but not limited to any information with regard to source of funds, whether or not I am granted credit. I further authorize the Westgate Las Vegas Resort & Casino to obtain any records from my banks and financial institutions.
If granted any credit, I agree to sign credit instruments, aka markers or checks (hereinafter “markers”) in the amount of funds (e.g. chips, cash, tokens, etc.) issued to me. I further authorize the Westgate Las Vegas Resort & Casino to complete any of the following information on those markers; (1) name of payee, (2) a date, (3) name, account number or address of any of my banks and financial institutions, (4) electronic encoding of the above and (5) any other information authorized by law. The information inserted may be for any account in which I now have, or may in the future obtain, the right to withdraw funds, regardless of whether that account now exists, and whether I provided the information on the account to the Westgate Las Vegas Resort & Casino. I hereby waive any right to place a stop payment on any marker and further waive any right of presentment for payment.
I acknowledge that irrespective of any gambling, debt collection, or currency exchange laws in the country in which I reside, I have the ability and intent to legally pay through my bank or financial institution the funds represented by the markers signed by me, and I hereby waive any such laws to the greatest extent permitted by law that may otherwise prohibit or limit my obligations as provided herein. To the extent that I am unable to waive such laws, I will arrange for payment through other accounts or by means to legally comply with all of my obligations.
I agree that each marker I sign is a separate transaction. If I receive the funds before I execute a marker, I will promptly sign a marker presented to me, in the amount of the funds I received.
I agree that any credit granted to me may be suspended or revoked at any time and without notice by the Westgate Las Vegas Resort & Casino, and I hereby release the Westgate Las Vegas Resort & Casino, including it’s officers, employees, representatives and agents, from any and all claims, damages or losses that I any incur as a result of such credit being suspended or revoked.
The provisions for the Westgate Las Vegas Resort & Casino agreeing to grant credit or accept front money deposits shall be governed by, and construed and enforced in accordance with the laws of the state of Nevada in regard to principales of conflicts of law. The parties hereto knowingly and intentionally waive the right to a jury trial in any issue or dispute that may arise between the applicant and the Westgate Las Vegas Resort & Casino. Any litigation arising hereunder or relating hereto shall only be brought in the courts in the state of Nevada or the courts if the United State of America located in Nevada, in either case in Clark County. The parties hereto consent to the personal jurisdiction of such courts and the undersigned waives all obligations or defenses thereto: provided, however, notwithstanding the foregoing, that in the event the Westgate Las Vegas Resort & Casino or its agents brings and action against applicant under this agreement and commences said action upon first impression within the territorial jurisdiction of applicant, then the parties shall be deemed to waive their respective rights with the respect to the venue provision contained herein. Said waiver shall not be construed in any manner to be a waiver of the choice of law provision contained herein. All costs regarding dispute shall be the responsibility of the applicant.
Warning: For the purposes of Nevada law, a credit instrument is identical to a personal check and may be deposited in or presented for payment to a bank or other financial institution on which the credit instrument is drawn. Willfully drawing or passing a credit instrument with the intent to defraud, including knowing that there are insufficient funds in an account upon which it may be drawn, is a crime in the State of Nevada which may result in criminal prosecution in addition to civil proceedings to collect the outstanding debt.
