We value our guests and recognize the importance of your personal privacy. This policy provides you with details on Turning Stone’s privacy practices with respect to the information we collect from/about you as a result of your interactions with us.
1. Personal Information We Collect and How We Use It
We do not collect personal information from you unless you voluntarily provide it to us or otherwise agree that we may collect it, including, without limitation, when you: (a) participate in our Concierge Club or loyalty program; (b) register for an account on a Turning Stone website; (c) make a reservation; (d) purchase a product or service; (e) participate in any of our promotions or events; (f) sign up to receive special offers or other marketing communications from us; (g) download and use our mobile application; (h) respond to a survey; or (i) contact us with questions, comments or concerns.
The type of personal information you may be asked to provide, or we may collect, includes information such as your name, date of birth, gender, mailing address, e-mail address, phone number, loyalty program account information, gaming activity, credit or debit card information, reservation and other transaction information and personal preferences.
We may use your personal information: (a) to validate your identity and prevent fraud; (b) to process and fulfill your reservations, purchases and other transactions; (c) to administer our Concierge Club, loyalty program and any other program, promotion or event you registered for; (d) to customize your Turning Stone experience; (e) for our own marketing purposes, such as notifying you of special offers, promotions and events via e-mail, text message, postal mail, phone and other means; (f) to better understand who our guests are and how they use our websites, products, services, programs, promotions and other offerings; (g) to improve our customer service, our websites and the products, services, programs, promotions and other offerings available to you; (h) for our own debt collection purposes; (i) to respond to any questions, comments or concerns you may have; (j) in accordance with any other consent you have given us; and/or (k) as required by applicable laws, rules or regulations, valid court order, or the terms and conditions applicable to our websites, Concierge Club, or loyalty or other programs.
We engage other companies to provide services on our behalf, such as credit card billing, reservation services, distributing communications to you, hosting and/or maintaining our websites, maintaining our databases and other information technology systems, performing website and guest analytics, and for various other purposes for which it may be necessary to provide them with your personal information. These parties are not authorized to use your personal information other than as necessary to provide these services on our behalf.
If you sign up for our Concierge Club or loyalty program, we may share your personal information with our business partners as necessary to administer these programs (e.g. so you can redeem points earned at Turning Stone for products or services purchased from one of our business partners, and vice versa). These business partners may only use your personal information for purposes of administering the programs.
We may also share your personal information with our business partners for their own or joint marketing purposes. We encourage you to read any privacy policies made available to you by our business partners to better understand how they may, in turn, protect and use your personal information. We may also share your personal information with third parties if we believe it is necessary to comply with applicable laws, rules or regulations or valid court order, or to protect our guests, employees, our property, the property of our business partners or the public from harm. Additionally, in the event of a business restructuring (such as a sale, merger or reorganization of our business or transfer of our assets), we may share your personal information with third parties that are a part of that transaction.
2. Non-Personal or Aggregate Information We Collect and How We Use It
When you use our websites or interact with us in other ways described below, we may collect and record certain non-personally identifiable information. For example:
Browsing History. When you visit our websites, like when you visit most other websites, certain information about your visit is automatically logged, such as server name, browser type and IP address through which you access the Internet, the date and time you accessed our websites, the pages you visited, and the internet address of the website, if any, from which you linked directly to our websites.
Cookies. We or our service providers may use "cookies" and similar technologies to help us recognize and serve you better. "Cookies" are small data files that may be placed and stored on your computer hard drive or device. They assign the computer or device a unique identifier so that we can recognize it when you return to our websites. Cookies are designed to save you time because they help us provide you with a customized experience without you having to remind us who you are, or what your preferences are, each time you return. Location Data. When you access our websites or use a computer or device at Turning Stone, we might collect information about your actual physical location via IP address or GPS signals or other similar technology. The information collected will be anonymous, unless you give us your consent to collect personal information using this technology. Most devices can be configured to disable GPS type technology.
3. Individuals Under Age 18
We do not solicit personal information from individuals under the age of 18. If you are a parent or legal guardian of an individual under the age of 18 and believe that we have collected personal information from him/her without your consent, please contact us at Promotions (Promotions@turningstone.com) with "Privacy Concerns" in the subject line and we will use all reasonable efforts to delete his/her information from our marketing database.
We have implemented technical, administrative, and physical security measures in an effort to safeguard the privacy of your personal information from unauthorized access or improper use. However, although we strive to protect the security of your personal information and our computer systems, no security measures are perfect or impenetrable, so we cannot guarantee that your personal information will be completely safe from unauthorized access or improper use (e.g. by hackers). By submitting personal information to us, you assume this risk.
Also, because we cannot enforce or control the security of the computers, devices or service providers (e.g. email or cell phone providers) you use to send personal information to us over the Internet, we are not responsible for the disclosure or interception of information you send before we receive it. For your own privacy, we recommend that you not include sensitive personal information (such as credit card data) in any email you may send to us.

Your Personally Identifiable Information
We may collect the following personally identifiable information should you voluntarily submit it to NRT through the Website or Services (by registering for an account, for example) either directly or through a third party that is a client of NRT or otherwise, including, but not limited to: your first and last name, your home and other physical address, your email address, your telephone number, your social security number, your date of birth, and other financial information ("Personal Information").
While providing service to credit applicants and lenders, we collect Personal Information from the following sources.
- credit applications and other standard forms related to customer accounts, including without limitation name, address, Social Security number, asset information, bank account balances, and financial transactions;
- customer transactions and other interactions directly with NRT and/or the Website or Services; and
- nformation obtained from third parties, such as the credit reporting agencies and financial institutions, when verifying credit applications or other forms or receiving information about your credit history. This information may also be obtained from other third parties or institutions with which you conduct non-financial transactions.
Usage Data and Website Activity
When you visit the Website, we may collect passive information about your visit. Passive information is any form of aggregate data, navigational data, tracking data, click-stream data, or historical data, which does not in itself personally identify you ("Usage Data"). For example, each time you use the Website, we automatically collect the type of Web browser you use, your operating system, your Internet Service Provider, your IP address, the pages you view, and the time and duration of your visits to the Website. We use this information to help us understand how people use the Website and Services, and to enhance the services we offer.
How Do We Use and Share Information
NRT will disclose your Personal Information in the following circumstances:
- to evaluate customer applications, we may communicate with financial institutions, including banks, credit unions, brokerage firms, savings & loans, and other third parties as necessary to make a full financial reporting on customer applications;
- to communicate with lenders as consented to by customers either through NRT or through a lender;
- to communicate directly with you in connection with your specific requests; and
- to provide you with products or services you have requested either directly or through a third party that is a client of NRT.
Keeping your information secure is a priority for NRT. We restrict access to your Personal Information to those employees and agents who need the information to assist in providing the Services. We maintain physical, electronic and procedural safeguards that comply with applicable law to protect your Personal Information. We train our employees in the proper handling of Personal Information.
Some pages of the Website may use security measures to protect against the loss, misuse or alteration of information that is transmitted through the Website. These pages use Secure Socket Layer ("SSL") connections with at least 128-bit encryption for certain transactions and confidential data. Unfortunately, no data transmission over the Internet or any other network can be guaranteed to be 100% secure. As a result, while we strive to protect your Personal Information, we cannot ensure or warrant the security of any information you transmit, and you do so at your own risk.
From time to time, we may establish business relationships with other businesses that we believe to be trustworthy and who have confirmed that their privacy practices are consistent with ours ("Service Providers"). For example, we may contract with Service Providers to provide certain services, such as hosting and maintenance, data storage and management, and marketing and promotions. We only provide our Service Providers with the information necessary for them to perform these services on our behalf. Each Service Provider must agree to use reasonable security procedures and practices, appropriate to the nature of the information involved, in order to protect your Personal Information from unauthorized access, use or disclosure. Service Providers are prohibited from using Personal Information other than as specified by NRT.
Children's Online Privacy Protection
The Website and the Services comply with the Children's Online Privacy Protection Act of 1998 (COPPA). NRT does not knowingly collect personally identifiable information from children under 13. If we become aware that we have inadvertently received Personal Information from a child under the age of 13, as soon as we verify the information, we will immediately delete the information from our servers. Compliance with Laws and Law Enforcement
NRT cooperates with government and law enforcement officials and private parties to enforce and comply with the law. We may disclose Personal Information and any other information about you to government or law enforcement officials or private parties if, in our discretion, we believe it is necessary or appropriate in order to respond to legal requests (including court orders and subpoenas), to protect the safety, property or rights of NRT or of any third party, to prevent or stop any illegal, unethical or legally actionable activity or to comply with the law.
Processing in the United States
Please be aware that your Personal Information and communications may be transferred to and maintained on servers or databases located outside your state, province, or country. If you are located outside of the United States, please be advised that we process and store all information in the United States. The laws in the United States may not be as protective of your privacy as those in your location. By using the Website or Services, you agree that the collection, use, transfer, and disclosure of your Personal Information and communications will be governed by the applicable laws in the United States.
Contact and Right to Access and Correct Information
You may contact us with any questions you may have about your Personal Information using the information below. If you prefer, we will copy and send to you any Personal Information we have about you. If you think the Personal Information that we have in our files is incomplete or incorrect, you may request that we complete or correct the disputed Personal Information.
