I give the Aliante Casino + Hotel and its representatives authorization to obtain and verify my financial information (including but not limited to account balance information) from any source and to exchange such information with others about my financial and account experience with the Aliante Casino + Hotel. I agree not to hold any entity responsible or liable for the information released, and further agree not to hold the Aliante Casino + Hotel responsible or liable for its use of any such information. I agree that the Aliante Casino + Hotel may retain and use the information on this credit application and any information it receives based on my authorization whether or not I am granted credit.
If granted any credit, I agree to sign credit instruments, aka markers or checks (hereinafter "markers") in the amount of the funds (e.g. chips, cash, tokens, etc.) issued to me. I further authorize the Aliante Casino + Hotel to complete any of the following information on those markers: (1) name of payee, (2) a date, (3) name, account number or address of any of my banks and financial institutions, (4) electronic encoding of the above and (5) any other information authorized by law. The information inserted may be for any account in which I now have, or may in the future obtain, the right to withdraw funds, regardless of whether that account now exists, and whether I provided the information on the account to the Aliante Casino + Hotel. I hereby waive any right to place a stop payment on any marker and further waive any right for presentment of payment. The terms stated in this credit application shall also apply to any personal or business check issued to the Aliante Casino + Hotel for the payment of any casino debt.
I represent that at the time I sign any marker, I have on deposit in accounts on which I am an authorized signatory for all purposes, without restriction, funds sufficient to pay such marker upon demand or presentment.
I acknowledge that irrespective of any gambling, debt collection or currency exchange laws in the country in which I reside, I have the ability and intent to legally pay through my bank or financial institution the funds represented by the markers signed by me, and I hereby waive any such laws that may otherwise prohibit or limit my obligations as provided herein.
I agree that each marker I sign is a separate transaction. If I receive the funds before I execute a marker, I will promptly sign a marker when presented to me, in the amount of the funds I received.
I agree that any credit granted to me may be suspended or revoked at any time and without notice by the Aliante Casino + Hotel, and I hereby release the Aliante Casino + Hotel, including its officers, employees and agents, from any and all claims, damages or losses that I may incur as a result of such credit being suspended or revoked.
Any actions or proceedings arising from the Aliante Casino + Hotel granting me credit, including the provisions of this application, shall be governed by and construed in accordance with the laws of the State of Nevada, without giving effect to its conflict of law provisions. I knowingly and intentionally waive the right to a jury trial concerning any action or dispute that may arise between me and the Aliante Casino + Hotel. Any litigation arising hereunder shall only be brought in the state or federal courts located in Clark County, Nevada. I hereby consent to the personal jurisdiction of such courts and waive all objections or defenses thereto; provided, however, notwithstanding the foregoing, that in the event the Aliante Casino + Hotel or its agents commence an action against me in another jurisdiction in which I may reside or hold assets, then the parties shall be deemed to have waived their respective rights with respect to the venue provisions contained herein. I further agree that if I do not pay any markers in full when due, that I will pay interest on all such markers at the rate of 18% per annum until paid in full, plus related costs and attorneys’ fees incurred by the Aliante Casino + Hotel. I understand that a marker is identical to a personal check under Nevada law, and may be deposited in or presented for payment to a bank or other financial institution on which such marker is drawn. Willfully drawing or passing a marker with the intent to defraud, including knowing that there is insufficient funds in an account upon which it may be drawn, is a crime in the State of Nevada, which may result in criminal prosecution in addition to civil proceedings to collect the outstanding debt.
